These Terms of Service ("Terms") govern your access to and use of the website beijinglikelocal.com and the morning experiences ("Service") offered by Beijing Like a Local ("we", "us", "our"). By booking an experience or using the Service, you agree to these Terms.

1. The Seller

The Service is provided by Beijing Like a Local, an individual seller based in China operating the trading name "Beijing Like a Local". You are contracting with us when you place a booking. You can reach us at hello@beijinglikelocal.com.

2. Acceptance

By browsing the website, completing a booking, or otherwise using the Service, you confirm that you accept these Terms and that you have authority to enter into them (either personally as a person of legal age, or on behalf of the people you are booking for).

3. The Experience

We offer guided morning experiences in Beijing, including the Essential, Classic and VIP packages described on our pricing page. The exact itinerary, meeting point, duration, and inclusions are confirmed in your booking confirmation email. We may make reasonable adjustments to the itinerary due to weather, safety, venue access, or local conditions.

4. Bookings and Pricing

Prices are listed in US dollars and shown at checkout. Adult and child rates apply per guest as displayed. Your booking is confirmed only when payment has been successfully completed and you receive a confirmation email from us.

5. Payments — Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax collection, currency conversion, invoicing, refunds and chargebacks are governed by Paddle's Buyer Terms.

6. Refunds and Cancellations

We offer a 30-day money-back guarantee. Full details are set out in our Refund Policy. Refunds are processed by Paddle, our payment provider.

7. Acceptable Use

You agree not to misuse the Service. You will not (a) use the Service for any unlawful, fraudulent or harmful purpose; (b) infringe any intellectual property rights; (c) attempt to gain unauthorised access to, probe, or otherwise interfere with the security or integrity of the website (including by introducing malware, scraping, or sending spam); or (d) impersonate any person.

8. Intellectual Property

The website, the Service, and all related content (text, photographs, branding, software) are owned by Beijing Like a Local or licensed to us, and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes.

9. Service Availability

We use reasonable efforts to keep the website and Service available, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with your booking or use of the Service shall not exceed the amount you paid for that booking. We exclude liability for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is prohibited by law.

11. Suspension and Termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated violations of our policies.

12. Governing Law

These Terms are governed by the laws of the People's Republic of China (excluding its conflict-of-laws rules). Any disputes will be resolved in the competent courts of Beijing, unless mandatory consumer-protection laws in your country of residence provide otherwise.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the latest revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.

4. 预订与价格

价格以美元结算并在结账页面显示。每位客人的成人与儿童价格按照展示标准计费。 只有在付款成功并收到我们发出的确认邮件后,您的预订方为有效。

5. 付款 — Paddle 作为登记商家

我们的订单处理由在线分销商 Paddle.com 负责。Paddle.com 是我们所有订单的"登记商家(Merchant of Record)"。 Paddle 负责处理所有客户咨询和退款事务。付款、结算、税费、币种转换、 发票、退款及拒付争议适用 Paddle 买家条款。

6. 退款与取消

我们提供 30 天无理由退款保证。详情请见退款政策。退款由我们的支付服务商 Paddle 处理。

7. 合理使用

您同意不滥用本服务,包括但不限于:(a)用于任何非法、欺诈或有害目的; (b)侵犯任何知识产权;(c)试图未经授权访问、探测或干扰网站的安全性或完整性 (包括植入恶意软件、抓取或发送垃圾信息);(d)冒充他人。

8. 知识产权

本网站、服务及所有相关内容(文字、照片、品牌、软件)均归 Beijing Like a Local 所有或经合法授权使用,并受知识产权法保护。您仅获有限、非独占、不可转让的 个人非商业使用权。

9. 服务可用性

我们将合理努力维持网站及服务的可用性,但不保证服务不中断或无错误。 在法律允许的最大范围内,我们不承担任何默示担保,包括适销性及特定用途适用性。

10. 责任限制

在法律允许的最大范围内,我们因您的预订或使用本服务而承担的累计责任不超过您该次预订所支付的金额。 我们不对间接、衍生或特殊损害(包括利润、数据或商誉损失)承担责任。 本条款不免除因欺诈、过失致死或人身伤害而依法不可免除的责任。

11. 暂停与终止

如发生重大违约、未付款、涉嫌欺诈或安全风险,或反复违反我们的政策, 我们有权暂停或终止您对服务的访问。

12. 管辖法律

本条款适用中华人民共和国法律(冲突法规则除外)。除您居住国强制性消费者保护法另有规定外, 所有争议由北京有管辖权的法院解决。

13. 条款变更

我们可能不时更新本条款。本页面顶部的"最后更新"日期反映最新版本。 在条款变更后继续使用本服务即视为接受更新后的条款。
